L02-HP: Yes
Rationale
Certicom disclosure 1541, submitted in April 2011 for the HIPv2 rfc5201-bis work, declares non-assertion of its controlled patent claims against compliant implementation if the standard is adopted. The Datatracker identifies RFC 7401 as the adopted successor of that draft. This is an attributable holder commitment satisfying the holder-bounded L02 rule; it is not merely a copyright license or IETF participation. Credit the declared non-assertion policy for its covered HIPv2 material, not an unlimited license to the entire stack.
Assessment method
Documentary commitment review; no patent clearance or runtime experiment
Source context
Primary holder disclosures and pinned implementation license, reviewed 2026-10-17
Outstanding qualification
The attached declaration identifies draft revision 05. Do not extend it automatically to later added mechanisms or separate ESP/mobility specifications. Conditions include compliance, seller notice, reciprocal licensing and broad defensive withdrawal, including possible past royalties after patent assertions against the holder, affiliates or their products. Optional royalty-bearing licenses do not erase the conditional non-assertion route. This records the published policy, not current patent validity, expiration, enforceability, third-party clearance or a legal finding that every RFC 7401 implementation is covered.
